Terms of Use & Service Guidelines

By browsing, accessing, or contracting digital engineering, web design, electronics consultation, or optimization services provided by Ekwebtasarim ("the Company", "we", "us", or "our"), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use.

If you are accepting on behalf of a corporation, partnership, or enterprise entity, you represent and warrant that you possess full legal authority to bind said entity to these terms.

Ekwebtasarim provides bespoke web development, user interface engineering, technical SEO enhancement, responsive front-end programming, and electronics-related digital integration services as agreed upon in designated Statements of Work (SOW) or project contracts.

We reserve the right to upgrade, modernize, or modify our technological architecture, design libraries, and development methodologies to maintain industry-standard security and cross-platform compatibility.

Unless otherwise stipulated in a signed project contract, upon full and final payment of all corresponding service fees:

• Client Deliverables: Custom graphic assets, authored text content, and client-specific business logic transfer to the client.
• Core Frameworks: Underlying reusable code modules, base scaffolding, development toolkits, and proprietary engineering workflows remain the intellectual property of Ekwebtasarim.
• Open-Source Elements: Third-party libraries and frameworks (such as Tailwind CSS and Phosphor Icons) remain governed by their respective open-source licenses.

Clients are solely responsible for ensuring that all data, brand assets, imagery, media, and copy supplied for project execution do not infringe on third-party trademarks, copyrights, or privacy statutes.

You agree not to use our code, infrastructure, or deployed web products for unlawful purposes, including but not limited to distributed denial-of-service attempts, distribution of malicious scripts, or deceptive consumer practices.

Payment terms, milestone schedules, and retainers are defined in individual service agreements. Standard project invoices are payable within fourteen (14) business days of issuance.

Delays in milestone approval or overdue disbursements may pause technical delivery schedules. Ekwebtasarim reserves the right to suspend staging server access for delinquent accounts.

All services are delivered in accordance with modern engineering standards and tested across modern mainstream web browsers. However, services and digital platforms are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of uninterrupted runtime.

We do not warrant that third-party hosting, APIs, or external electronics integrations will operate free of third-party platform interruptions.

To the maximum extent permitted by applicable law, in no event shall Ekwebtasarim or its contractors be liable for any indirect, incidental, punitive, or consequential damages, including loss of business profits, data corruption, or downtime.

Our cumulative aggregate liability arising from any contract or service delivery shall not exceed the total amount received by us from the client under the specific Statement of Work during the three (3) months preceding the claim.

Either party may terminate an ongoing service agreement by providing thirty (30) days written notice. In case of material breach, termination may take effect immediately upon written notice.

Upon termination, the client shall compensate Ekwebtasarim for all billable hours, completed milestones, and non-cancelable third-party commitments incurred up to the effective termination date.

These Terms shall be interpreted and governed in accordance with applicable business legislation. Any disputes arising from these Terms or our digital services shall first be submitted to mutual good-faith negotiation.
